A man accused of murdering a man just a day before his 23rd birthday, stands trial.

Jassen Barnes is accused of shooting Justin Thomas once in the heart at the Dietrich Road Apartments in July 2011.

Thomas' girlfriend, Lajoi Haynes, told jurors she heard the gunshots then saw her boyfriend running away.

"He didn't say nothing," said Haynes in tears. "We were just sitting there, praying with him."

Haynes said Barnes was the one who killed Thomas.

In opening arguments, Prosecutor Tanner Neidhardt said Barnes didn't count on several witnesses the day of the murder.

"Jassen Barnes has his target on, very quickly, very accurately," said Neidhardt. "All of the witnesses are going to tell you - I heard two or three shots - Pow, Pow, Pow!"

Neidhardt did not give a motive to the shooting.

If convicted, Barnes is facing 25 years to life in prison - since he has a criminal record, which includes serving time behind bars.

2 North Texas men charged with neglecting pony

SPRINGTOWN, Texas (AP) -- Two North Texas men are facing animal cruelty charges for allegedly neglecting a Shetland pony that was malnourished, suffering from an infected wound and living in squalid conditions.

The owner of the pony, Jesse Ray Cross, and the pony's caretaker, Franky Lynn Hatcher-Cross, are free on bond after being arrested Saturday on charges of cruelty to livestock animals.

The pony was found in Springtown, located about 60 miles northwest of Dallas. Investigators say the pony was severely underweight and had no food or clean water nearby.

Veterinarian staff treating the pony say they will have to wait for its infection to improve before they can operate.

Parker County Sheriff Larry Fowler says he will care for the animal and pay for its treatment. He has renamed the pony Achilles.
