Brother of 10-year-old killed in shooting says suspect had been threatening him
SAN ANTONIO -- A memorial now sits on the front porch of Delilah's home. The family says they feel a sense of relief after the recent arrests.
Police say the 10-year-old was asleep in her bed thanksgiving morning when the home was blasted with bullets. 18-year-old Cody Gann is now charged with her murder.
"Justice for my daughter and we can sleep a little bit better,” says the mother of the victim Jacqueline Vega.
According to the arrest affidavit, Gann and Delilah’s older brother are in rival gangs. Police say this shooting was in retaliation for previous drive by shootings, Gann claims the brother was involved in.
"I can't say what I want to say to him, but you are going to get what you deserve, one way or another,” said Vega.
Police also arrested 19-year-old jasmine Cary on a felony warrant for evading arrest.
But, in Gann’s affidavit, police say they received an anonymous tip that Cary too is responsible for the murder. The paperwork says Cary previously dated Delilah’s older brother before Gann. And there may be reason to believe she was there when the shooting happened.
"18 year olds, 17 year olds, carrying these types of weapons is horrible and I am glad that we have one individual off the streets,” said Pastor Jimmy Robles.
A funeral will take place for Delilah Sunday night at 7-pm at last chance ministries.

More details were released Friday concerning the arrest of an 18-year-old man in the shooting death of a 10-year-old girl who was killed on Thanksgiving Day.
Delilah Hernandez was in her bedroom when gunshots were fired from outside the house, striking her in the chest. Police took Cody Gann into custody Thursday night in connection with the deadly shooting. He is now charged with murder.
Chief McManus previously said Delilah's older brother believes he was the target. An arrest affidavit for Gann states he was in rival gang and that the brother had previously dated Gann's current girlfriend, 19-year-old Jasmine Cary.
Cary has also been arrested by police and is being held on an unrelated felony evading arrest warrant. A police affidavit says Cary was also present the night of the shooting.
Investigators believe the shooting was in retaliation for several drive-by shootings that had taken place days before. Police say Delilah's brother told them Gann and Cary had both been threatening him for several days.
